Terms of Service

1. Introduction

Welcome to WedBuild. These Terms of Service ("Terms") govern your access to and use of the WedBuild platform, including the website at https://app.wedbuild.com, all related applications, features, and services (collectively, the "Service"), operated by WedBuild Pty Ltd (ABN 88 691 899 466), an Australian company ("WedBuild," "we," "us," or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and WedBuild. Please read them carefully.


2. Eligibility

To use WedBuild, you must:

  • Be at least 18 years of age (or the age of majority in your jurisdiction)
  • Have the legal capacity to enter into a binding agreement
  • Provide accurate and complete registration information
  • Not have been previously suspended or removed from the Service

If you are using the Service on behalf of another person (e.g., as a wedding planner), you represent that you have authority to bind that person to these Terms.


3. Account Registration and Security

3.1 Creating an Account

You may create an account using an email address and password, or by signing in with Google. You agree to provide accurate, current, and complete information during registration and to keep it up to date.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately at support@wedbuild.com if you suspect unauthorised access

We are not liable for any loss or damage arising from your failure to maintain the security of your account.

3.3 Account Types

Couple accounts are intended for planning a single wedding event. You may share access with your partner or authorised collaborators, but each wedding should have one primary account.

WedBuild Planner accounts (for professional wedding planners) do not hold a wedding of their own. They exist to create and manage client weddings: one login may manage multiple weddings (subject to the wedding cap of your subscription tier, described in Section 5.9) and may belong to one planner team.

Any account may additionally hold access that others share with it — for example, a wedding shared with a planner, a teammate, or a vendor on a view-only basis.


4. The Service

4.1 Description

WedBuild is a wedding planning platform that provides tools including:

  • Guest list management and RSVP collection
  • Wedding website builder and publishing
  • Seating chart creation (drag-and-drop and visual layouts)
  • Budget planner with expense tracking, invoices, and payment records
  • Vendor comparison and management
  • Wedding checklist and task management
  • Announcement and email campaign tools
  • Event scheduling and a wedding-day run sheet (itinerary) with shareable schedules
  • QR code generation and "Find My Seat" functionality
  • AI-powered planning assistance (availability varies by plan — see Section 10)
  • Forms, questions, and guest self-entry
  • For professional wedding planners: multi-wedding client management, team access, and read-only sharing with venues and vendors (WedBuild Planner)

4.2 Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will endeavour to provide reasonable notice of planned downtime.

4.3 Modifications to the Service

We reserve the right to modify, update, or discontinue any part of the Service at any time. If we discontinue a material feature that affects your paid subscription, we will provide reasonable notice and, where appropriate, a pro-rata refund.


5. Subscription Plans and Pricing

5.1 Couple Plans

For couples planning their own wedding, WedBuild offers the following tiers:

  • Free: Core features with a guest limit of 50
  • Standard: Extended features including unlimited guests, budget planner and drag-and-drop seating
  • Pro: Full feature set including visual seating charts, vendor comparison, AI wedding assistant, and QR seating

Feature availability and plan limits are described on our pricing page and may be updated from time to time.

Professional wedding planners are served by a separate product, WedBuild Planner, described in Section 5.9.

5.2 Pricing and Payment

  • Prices are displayed in Australian Dollars (AUD) unless otherwise stated. WedBuild Planner subscriptions may be billed in a supported local currency (currently AUD, USD, NZD, GBP, EUR, JPY, or CAD) as selected at checkout; the amount you will be charged is always shown before you subscribe.
  • Payment is processed securely by Stripe. By subscribing, you also agree to Stripe's Terms of Service.
  • You authorise us to charge the payment method you provide for the applicable subscription fees.
  • Prices are subject to change. We will notify you of any price changes at least 30 days before they take effect; for recurring subscriptions, changes apply from your next billing cycle after the notice period. Continued use after a price change constitutes acceptance of the new pricing.

5.3 Billing (Couple Plans)

  • One-time plans: Standard and Pro subscriptions are available as a one-time payment that covers a fixed subscription period (currently 2 years). Your subscription remains active until the expiry date shown in your account settings.
  • Monthly plans: Monthly continuation subscriptions are available to extend your access after your one-time subscription period ends. Monthly plans are billed at the start of each billing cycle and renew automatically until cancelled.
  • Subscribe now, charge later: You may subscribe to a monthly plan at any time during your active one-time subscription. You will not be charged until your one-time plan expires, at which point monthly billing begins automatically.

5.4 Free Trial (Couple Accounts)

New couple accounts that complete onboarding and create their own wedding receive a free trial of the Pro plan, where the trial offer is available. Weddings created for you by a WedBuild Planner are covered by that planner's subscription instead and do not receive a separate trial. The trial works as follows:

  • The trial lasts 7 days and begins when you complete onboarding and your wedding is created.
  • No payment details are required. There is nothing to cancel — the trial simply ends, and you will never be charged as a result of starting one.
  • During the trial you have access to Pro features, with two limits: guest lists remain limited to 50 guests (the same limit as the free plan), and the AI assistant runs on a smaller usage allowance than a paid plan. Both apply for the duration of the trial.
  • When the trial ends, your account automatically moves to the free plan. Your data is retained in full; features not included in the free plan become unavailable until you purchase a paid plan, at which point access to them is restored.
  • Trials are limited to one per account. We may withhold or withdraw a trial where we reasonably believe it is being used to circumvent these limits.
  • We may change or discontinue the trial offer at any time. Any trial already in progress will run for its remaining term.
  • The read-only mode and retention timeline in Section 5.5 apply only to expired paid subscriptions. They do not apply when a free trial ends — your account simply continues on the free plan, with your data intact.

5.5 Couple Subscription Expiry and Account Lifecycle

This section applies to couple accounts. When your paid couple subscription expires and no monthly plan is active:

  • Your account enters read-only mode. You can log in and view your data but cannot create, edit, or delete content.
  • Your published wedding website will be automatically unpublished (taken offline).
  • Your RSVP forms will be automatically closed (guests can no longer submit responses).
  • A 12-month retention period begins. During this time, you can restore full access by subscribing to a monthly plan.
  • If you do not resubscribe within 12 months, your account and all associated data will be permanently deleted in accordance with our Privacy Policy.
  • We will send you email notifications at key intervals throughout this process (before expiry, at expiry, and during the retention period).

5.6 Monthly Plan Cancellation

  • You may cancel your monthly subscription at any time from your account settings.
  • Cancellation takes effect at the end of your current billing period. You will retain access until then.
  • After cancellation takes effect, your account will follow the expiry process described in Section 5.5.

5.7 Refunds

  • If you are unsatisfied with a paid plan, you may request a refund within 14 days of purchase by contacting support@wedbuild.com.
  • Refunds after the 14-day period are at our sole discretion.
  • Refunds are processed via the original payment method and may take 5–10 business days to appear.
  • Monthly subscription refunds are limited to the most recent billing cycle.

5.8 Free Plan Limitations

The free plan is subject to feature and usage limitations (e.g., a guest limit of 50). We reserve the right to modify free plan limitations at any time.

5.9 WedBuild Planner Subscriptions (Professionals)

WedBuild Planner is a monthly subscription for professional wedding planners. It is separate from the couple plans above and works as follows:

  • Tiers and wedding caps. Planner tiers (currently Solo, Studio, Agency, and Unlimited) provide identical features and differ only in how many client weddings you can manage at once (your "wedding cap"). Current tiers and pricing are shown on our pricing pages and at checkout. The included demo wedding never counts toward your cap. Reaching your cap prevents creating new client weddings; it never removes your access to existing ones.
  • Recurring billing. Planner subscriptions are billed monthly in advance and renew automatically each month until cancelled.
  • Free trial. New Planner subscriptions include a 14-day free trial. A payment method is required to start the trial, and the first charge occurs when the trial ends unless you cancel before then. Cancelling during the trial takes effect immediately and you will not be charged. Each account is eligible for one trial.
  • Plan changes. You can change tiers at any time from your account settings. Upgrades apply immediately, with a prorated charge for the remainder of the current billing period. Downgrades take effect at the end of the current billing period, and are available once the number of weddings you manage fits within the smaller tier's cap. During a trial, tier changes apply immediately without charge.
  • Cancellation. You may cancel at any time from your account settings. After the trial, cancellation takes effect at the end of the current billing period, and you retain paid features until then.
  • Failed payments. If a renewal payment fails, our payment processor will retry it and we will notify you. Paid features remain available during the retry window; if payment ultimately cannot be collected, the subscription lapses with the effects described below.
  • Effect of lapse or cancellation. When a Planner subscription ends, the weddings it covered are not deleted: they revert to Free-plan features until you resubscribe (or, for a wedding handed over to its couple, until the couple upgrades it). Your account and your access to your weddings remain. The read-only mode and retention timeline in Section 5.5 do not apply to Planner accounts.
  • Teams. Your subscription covers the team members you invite to your practice. The subscribing account (the practice owner) is responsible for all subscription charges and for its team members' use of the Service in accordance with these Terms. A team member's access ends when their membership is removed or the subscription lapses.
  • Client weddings. Client weddings you create are managed under your account. You may invite the couple at any time; they join with their own (free) accounts. Handing a wedding over to the couple transfers control to them, removes it from your wedding cap, and moves it onto the couple's own plan (the Free plan until they upgrade). Deleting a client wedding permanently deletes that wedding's data.
  • Demo wedding. Planner accounts include a demonstration wedding containing fictional data for evaluation purposes. It cannot be used to send guest communications.

6. Your Content

6.1 Ownership

You retain full ownership of all content you upload, create, or submit through the Service ("Your Content"), including text, images, guest data, wedding details, website designs, and communications.

WedBuild does not claim any ownership rights over Your Content.

6.2 Licence to WedBuild

By uploading or creating content on WedBuild, you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable licence to use, store, copy, process, display, reproduce, modify, and create derivative works of Your Content for the following purposes:

  • Service delivery: Storing, backing up, and displaying Your Content on our servers and those of our service providers; displaying Your Content on published wedding websites and public pages you choose to make available; processing Your Content to provide features (e.g., sending emails to your guest list, generating seating charts, powering AI assistant responses)
  • Showcase, marketing, and templates: Using published wedding website designs, layouts, and content (with personal details such as guest names, contact information, and private data removed or anonymised) as templates for other users, promotional materials, marketing examples, portfolio showcases, social media content, and on our website

The licence for service delivery purposes terminates when you delete Your Content or your account, except where retention is required by law or as described in our Privacy Policy. The licence for showcase, marketing, and template purposes survives account deletion and termination of your subscription, as these uses rely on anonymised or non-personal creative content.

You may opt out of the marketing and template licence at any time by contacting us at support@wedbuild.com. Upon receiving your opt-out request, we will cease using Your Content for marketing and template purposes within 30 days, though existing templates already in use by other users may remain available.

6.3 Content Responsibilities

You are solely responsible for Your Content. You represent and warrant that:

  • You own or have the necessary rights, licences, and permissions to use and share Your Content
  • Your Content does not infringe the intellectual property rights, privacy rights, or other rights of any third party
  • Your Content does not contain unlawful, defamatory, obscene, or otherwise objectionable material
  • Any guest information you collect has been obtained with appropriate consent or legal basis
  • If you use the Service as a professional (for example, under a WedBuild Planner subscription), the same responsibilities apply to content and personal information you enter about or on behalf of your clients and their guests, and you warrant that you have your client's authority to do so

6.4 Published Wedding Websites

When you publish a wedding website, the content becomes publicly accessible to anyone with the URL. You are responsible for the content you choose to publish. WedBuild does not review or moderate published wedding websites but reserves the right to remove content that violates these Terms.


7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Upload or distribute malware, viruses, or other harmful code
  • Send unsolicited bulk communications (spam) to your guests or any third party
  • Collect guest information for purposes unrelated to your wedding (e.g., commercial marketing, data harvesting)
  • Attempt to gain unauthorised access to the Service, other accounts, or our systems
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use the Service to create a competing product
  • Impersonate any person or entity
  • Use automated scripts, bots, or scrapers to access the Service without our prior written consent
  • Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Use the AI features to generate content that is harmful, misleading, or violates any law

We reserve the right to suspend or terminate your account for violations of this Section without prior notice.


8. Intellectual Property

8.1 WedBuild IP

The Service, including its design, code, features, branding, logos, documentation, and all underlying technology, is the property of WedBuild Pty Ltd and is protected by Australian and international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works based on any part of the Service without our prior written consent.

8.2 Feedback

If you provide us with suggestions, ideas, or feedback about the Service ("Feedback"), you grant us an unrestricted, perpetual, irrevocable, royalty-free licence to use that Feedback for any purpose without compensation or attribution to you.

8.3 Templates

Wedding website templates, announcement designs, and other creative assets provided by WedBuild are licensed to you for use within the Service only. You may not extract, redistribute, or sell these assets outside of WedBuild.


9. Third-Party Services

9.1 Integrations

The Service integrates with third-party services including Stripe (payments), Resend (email delivery), Google (authentication, maps, fonts), OpenAI and Anthropic (AI features), Sentry (error monitoring), and PostHog (analytics). Your use of these third-party services is subject to their respective terms and privacy policies.

9.2 Links

The Service or published wedding websites may contain links to third-party websites. We do not control and are not responsible for the content, practices, or availability of third-party websites.

9.3 No Endorsement

The inclusion of any third-party service or link does not constitute an endorsement or recommendation by WedBuild.


10. AI Features

10.1 Availability

AI features (the AI Help guide and the AI Wedding Assistant) are provided as a convenience and are subject to availability. They are powered by third-party AI models (currently from OpenAI and Anthropic).

The AI Help guide is available to all users. The AI Wedding Assistant is available on eligible couple plans only — it is not included with WedBuild Planner accounts or with weddings managed under a WedBuild Planner subscription.

10.2 Accuracy

AI-generated content is provided for informational and planning purposes only. It may contain errors, inaccuracies, or outdated information. You should not rely on AI-generated content as professional, legal, financial, or medical advice. You are responsible for reviewing and verifying any AI-generated suggestions before acting on them.

10.3 Usage Limits

AI features are subject to fair-use rate limits and, for the AI Wedding Assistant, an included usage allowance with optional top-up credit packs (your current usage is shown in your account settings). Limits and allowances may change at any time.

10.4 Data Processing

When you use AI features, relevant wedding data is sent to our AI model providers for processing. See our Privacy Policy for details on how this data is handled.


11. Email and Communication Features

11.1 Your Responsibility

When you use WedBuild to send emails or announcements to your guests (or, as a professional, to your clients' guests), you are the sender. You are responsible for:

  • Ensuring you have the consent of recipients to contact them
  • The content of all communications you send
  • Complying with applicable anti-spam laws, including the Australian Spam Act 2003 (Cth), the US CAN-SPAM Act, and the EU ePrivacy Directive

11.2 Prohibited Uses

You must not use WedBuild's communication features to:

  • Send unsolicited commercial messages
  • Send deceptive, fraudulent, or misleading communications
  • Distribute malware or phishing attempts
  • Send communications to purchased or harvested email lists

11.3 Email Tracking

WedBuild provides open and click tracking for emails and announcements you send. This tracking is performed on your behalf using our email delivery provider (Resend). You are responsible for informing your recipients about this tracking where required by applicable law.

11.4 Delivery

We use commercially reasonable efforts to deliver emails but cannot guarantee delivery, as it depends on recipient email providers, spam filters, and other factors beyond our control.


12. Data and Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms.

By using the Service, you acknowledge and agree to the data practices described in the Privacy Policy.


13. Disclaimers

13.1 "As Is" Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

13.2 No Guarantees

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • Any defects will be corrected
  • The results obtained from the Service will be accurate or reliable
  • The Service will meet your specific requirements

13.3 Wedding Planning

WedBuild is a planning tool, not a wedding coordinator, legal advisor, or financial advisor. We are not responsible for the outcome of your wedding, vendor relationships, budget decisions, or any other real-world consequences arising from your use of the Service.


14. Limitation of Liability

14.1 Exclusion of Certain Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WEDBUILD, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your use of or inability to use the Service
  • Unauthorised access to or alteration of your data
  • Any third-party conduct on the Service
  • Any content obtained from the Service
  • Any interruption or cessation of the Service

14.2 Cap on Liability

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF:

  • The amount you paid to WedBuild in the 12 months preceding the claim, or
  • One hundred Australian dollars (AUD $100)

14.3 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement. If the Australian Consumer Law applies to you as a consumer, and WedBuild cannot exclude liability, our liability is limited to (at our option): supplying the services again, or paying the cost of having the services supplied again.

14.4 EU/UK Users

If you are a consumer in the EEA or UK, nothing in these Terms affects your statutory rights under applicable consumer protection legislation, including the Consumer Rights Act 2015 (UK) or the Consumer Rights Directive (EU).


15. Indemnification

You agree to indemnify, defend, and hold harmless WedBuild Pty Ltd, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service
  • Your Content
  • Your violation of these Terms
  • Your violation of any law or the rights of any third party
  • Guest data you collect, use, or disclose through the Service

This indemnification obligation does not apply to the extent that a claim arises from WedBuild's own negligence or wilful misconduct.


16. Termination

16.1 By You

You may stop using the Service at any time. You may delete your account by contacting support@wedbuild.com. Upon account deletion:

  • Your data will be deleted in accordance with our Privacy Policy
  • Published wedding websites will be taken offline
  • Active subscriptions will not be refunded except as provided in Section 5.7
  • If you hold a WedBuild Planner account, deleting it ends your access to every wedding shared with you; data belonging to couples' own accounts is unaffected

16.2 By WedBuild

We may suspend or terminate your access to the Service at any time if:

  • You breach these Terms
  • Your use of the Service poses a security risk or may harm other users
  • We are required to do so by law
  • We discontinue the Service

Where possible, we will provide reasonable notice before termination and an opportunity to export your data. In cases of serious breach or legal requirement, we may terminate immediately without notice.

16.3 Survival

The following sections survive termination: Section 6.2 (Licence), Section 7 (Acceptable Use), Section 8 (Intellectual Property), Section 13 (Disclaimers), Section 14 (Limitation of Liability), Section 15 (Indemnification), Section 17 (Governing Law), and Section 18 (Dispute Resolution).


17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of South Australia, Australia, without regard to its conflict of law provisions.

Subject to Section 18, the courts of South Australia shall have non-exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

For users in the European Union or United Kingdom, nothing in this section deprives you of the protection of mandatory provisions of the law of your country of residence or your right to bring proceedings in the courts of your country of residence.

For users in California, USA, nothing in this section limits your rights under the CCPA/CPRA or your ability to bring claims in your local jurisdiction where required by law.


18. Dispute Resolution

18.1 Informal Resolution

Before initiating formal proceedings, you agree to first contact us at support@wedbuild.com to attempt to resolve the dispute informally. We will endeavour to respond within 14 days and to resolve the matter within 30 days.

18.2 Mediation

If informal resolution is unsuccessful, either party may refer the dispute to mediation administered by the Resolution Institute in Adelaide, South Australia, in accordance with their mediation rules. The costs of mediation shall be shared equally.

18.3 Court Proceedings

If mediation is unsuccessful, either party may commence court proceedings in the courts of South Australia, subject to any mandatory jurisdictional rights you may have under the laws of your country of residence.

18.4 Small Claims

Nothing in this section prevents either party from seeking urgent injunctive or equitable relief, or from filing a claim in a small claims court of competent jurisdiction.


19. General Provisions

19.1 Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and WedBuild regarding the Service and supersede all prior agreements and understandings.

19.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

19.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. A waiver is only effective if made in writing and signed by WedBuild.

19.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

19.5 Force Majeure

WedBuild shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including natural disasters, war, terrorism, pandemics, strikes, government actions, power failures, or internet or telecommunications failures.

19.6 Notices

We may send notices to you via the email address associated with your account or by prominent display within the Service. You may send notices to us at support@wedbuild.com.

19.7 No Agency

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and WedBuild.


20. Changes to These Terms

We may update these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will make reasonable efforts to notify you by email or prominent notice within the Service.

Your continued use of the Service after the updated Terms are posted constitutes your acceptance of the changes. If you do not agree to the updated Terms, you should stop using the Service.
